We are based at 1 Farleigh Place, London N16 7SX. By browsing and purchasing items from this website you are agree to be bound by these terms and conditions. These terms and conditions are helpful for both you and us, as they give useful information and outline what we expect from each other. We recommend that you read these and contact us if you have any questions. Please do not use this website if you do not agree to these terms and conditions.

1. Our Rights

Jackson’s Art Supplies reserves the right to modify or withdraw (either temporarily or permanently) any part of this website with or without prior notification. We may make changes without notifying you, it is your responsibility to ensure that you are aware of any new changes. If you continue to purchase goods that are affected by any changes you express your acceptance of the changes. If you do not agree to any changes, then please stop using the website and contact us.

2. About You

To place an order on our website, you need to be over 18 years of age.

3. Use of the Website

When registering as a customer you must ensure that all the information you provide is true and accurate and as complete as possible. You agree not to use a false name or register as someone else without that person’s prior knowledge and permission, or create multiple accounts. We reserve the right to delete these accounts at any time.

All information we collect or is voluntarily submitted on the Jackson’s Art website is protected under our Privacy Policy

This policy explains our role as a data controller when we use your personal information in order to fulfil the orders places with us or interact with us through our website.

We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you with an opportunity to opt-out or otherwise prohibit such unrelated uses. We will always provide you with a simple way to opt out later should you change your mind.

4. Pricing

We work out our prices without GST. We then add GST to the cost of items for customers who pay it. Some of our prices may be rounded to the nearest cents. Occasionally, when buying large quantities of the same thing, items may appear to be an extra cent or two more expensive. For example, a half pan that retails for 20c including GST will be more like 20.01c. A customer ordering 100 of them will be charged $20.01 as a result. While we are unable to change this, we are happy to remove the difference between the displayed price and the actual price. Please contact our Customer Service Team if your order is affected. 

All prices listed on our website are inclusive of GST except for GST-exempt products. If you purchase goods to be delivered outside of Australia, the GST will be removed from your order during Checkout.

Please note, orders shipped from the UK, and over $1000 AUD, are not subject to GST at checkout, but will be assessed by Australian customs and have GST and import duty applied at entry. Orders shipped from Adelaide are only subject to GST.

5. Lowest Prices on the Web Guarantee

Jackson's is never knowingly beaten on price and we regularly check our competitor’s prices to make sure we offer the best prices.

We try to provide our customers with the best possible value and service on our wide range of high-quality art materials. If you find the same product at a lower price on an Australian website just let us know where you have seen it and we will match the price. If you find a lower price within seven days of your purchase from Jackson’s Art Supplies, we will credit the difference to your account. 

*excludes products that are part of a bundle, set or pack, products on promotion exceeding 45% discount, clearance items, auction websites, products on marketplace websites, non-Australian owned websites, and products on promotion outside the offer dates.

The material on this website is protected by all applicable laws including copyright and trademark laws under the laws of England and Wales and other countries through international treaties. Unless otherwise indicated, all content (such as text, images, graphics, logos, button icons, video images, audio clips, navigational and other software) on jacksonsart.com is the property of Jackson's Art Supplies. Permission is granted to reproduce text and images found on this website for personal and educational use only. Commercial copying, hiring, and lending is prohibited. Any infringement of these rights will be investigated.

7. LINKS TO THIRD-PARTY WEBSITES

This website may use social networks and may contain social media links, applications, or features (including but not limited to Youtube, Facebook, Twitter, and Instagram). Your use of any social media platform is subject to that social media platform’s terms and conditions of use. This website is not sponsored, endorsed or administered by, or associated with, any social media platform.

8. Suitability for use

While we take good care to maintain the highest standards of quality in our products, it is your responsibility to ensure that the goods purchased are suitable for your requirements and that the goods arrive in an acceptable condition. Many of our products are made from natural substances whose behaviour can vary in different environments. Their structure can also vary according to the assembly process. Jackson's strive to maintain consistency and continuity in these matters and under no circumstances will entertain claims for the value of work alleged to have been adversely affected by the use of any of our products that prove to be unsatisfactory to the user. Our liability is confined to the value of the goods alone. 

9. Order Processing

Contract Creation and electronic contracting 

The following steps are required to create a contract between you and us:

You place the order for your products on the website by pressing the confirm order button at Checkout. You will place an order by following a series of simple instructions on the website

When you place an order, you will receive an acknowledgement email confirming receipt of your order 

We accept your order after payment is approved and we have debited the payment card 

-  As your product is shipped, we will send you a dispatch confirmation email  

The completion of the contract between you and us will take place on the dispatch of the products ordered unless we have notified you that we do not accept your order, or you have changed or cancelled the order by contacting us within 24 hours of placing the order

On rare occasions, we may need to cancel or refuse your order. This may be as a result of one of the following:

The product you ordered is unavailable from stock

We are unable to obtain authorisation for your payment

The identification of a pricing or product description error  

You do not meet the eligibility to order criteria set out in the main Terms & Conditions 

We will contact you if there is an issue with your order. 

All correspondence throughout the order process will be in English. 

10. Special Order Items

Some items listed on our website are marked as ‘special order’ items and such products are not kept at our warehouse/s. If you purchase one of these items there is likely to be a delay on your entire order until the special order item has arrived from our suppliers.

The estimated delivery dates shown on the website are derived from the estimated date of the next delivery due from the manufacturer of the product. This does not guarantee that the manufacturer has sufficient stock of this item and will deliver the item on this date.

If you are looking for an item produced by a manufacturer that supplies other products that are for sale on our website, please get in touch as we may be able to special order the item for you.

11. Credit/Debit Card Payment

We accept the following credit and debit cards as payment: Visa, MasterCard, Switch, Maestro, Solo, and American Express.

Jackson’s Art Supplies will take payment at the time of ordering (online). A refund and cancellation may be obtained at any time. If you are shopping from outside of the UK, place your order and your credit card company will convert the transaction to your own currency. All transactions will be charged in pounds sterling and will be converted at the then-current applicable exchange rate by your credit card company.

12. Orders by Post

If you wish to pay by cheque you will need to send your order in by post. You can write the order out on plain paper or print off a blank order form from the website. Please make the cheque out to Jackson's Art Supplies. The processing time will be delayed by however long it takes for the order to reach us. Alternatively, you can phone or email the order through and we will issue you with an order reference number once the order is on our computerized system. We will ask you to write the order reference number on the back of your cheque.

13. DELIVERY, IMPORTS, AND TAX

All delivery dates are based on estimated delivery times only. There may be delays, both locally or on international orders due to unexpected situations or Customs.

Please note, delivery times are an estimate based on working days, Monday to Friday, and exclude local bank holidays.

UK
The current UK VAT rate is 20%. This will be included on all orders delivered to an address in the United Kingdom.

Channel Islands
There are no import duties or Customs fees. Orders are also VAT exempt - to ensure that this is processed correctly, please set your delivery country to Jersey or Guernsey rather than the United Kingdom.

European Union
Orders below €150 (euros)

Ordering from our US Warehouse
If the products in your Basket are available in our US Warehouse, the order will be shipped domestically. If that is the case, in the Checkout:

Sales Taxes will be automatically applied as per domestic US rules.

Australia

Ordering from our UK Warehouse
If the products in your Basket are only available in our UK Warehouse, the order will be shipped internationally. If that is the case, in the Checkout:

Sales Taxes will be automatically applied as per the rules below:

Orders below AUD $1000 are inclusive of a 10% GST, added to your Basket and there are no additional import duties or Customs fees.

Orders over AUD $1000 will not include GST, and will be processed by Australian customs and import duty and other fees will be applied.

Ordering from our Australia Warehouse
If the products in your Basket are available in our AU Warehouse, the order will be shipped domestically. If that is the case, in the Checkout:
-  The delivery options shown will all be domestic shipping methods ("AUS").
Sales Taxes will be automatically applied as per domestic Australian rules.

Canada
Orders are exempt from Sales Tax at the Checkout. If the full value of your items is over 20 CAD, the import tax on your order will be 5% payable to Canadian customs.

Norway
Norwegian Artists:

VOEC Scheme (VAT on Ecommerce) is meant for sales to consumers (B2C sales).

Orders are inclusive of a 25% VAT, which is added to your Basket, and there are no additional import duties or customs fees. Our Norway MVA number is: 2033224.

Norwegian Business Customers:

If you are a business, the sale is not covered by the VOEC Scheme, instead sales to businesses (B2B sales), requires Norwegian businesses to provide their organisation number. This has nine digits, starting with eight or nine. Please send this number via the website chat with your order number. We will remove the VAT from your order and add your number to the shipping documents. Import VAT and duty will be payable at Norwegian customs.

Israel
Orders are exempt from Sales Tax at the Checkout, and up to US $75 they are not subject to import charges. However, orders over US $75 are subject to 17% import tax and possibly fees.

Japan
Orders are exempt from Sales Tax at the Checkout, however if the full value of your items is over 10000 JPY, the import tax on a shipment will be 10%.

Rest of World (RoW)

Orders are exempt from Sales Tax at the Checkout. Local authorities and Customs may request Import Fees in lieu of this.

Please check locally for duty-free limits or import duty charges.


Refusing an Order 

Please note, international orders refused by the recipient may have Return to Sender fees applied by the courier. We reserve the right to deduct this courier fee from any refund owed on the returning goods.

14. Returns Policy

We understand that sometimes you may want to return an unwanted item and get your money back. We are happy to issue credit notes or refunds for any items with proof of purchase from Jackson’s Art Supplies that are returned in a saleable condition within 30 days of the receipt of your order. You are responsible for returning the items to us. The items must be securely packaged to ensure that they arrive back to us undamaged. You must let us know about any order errors or shortfalls within seven days. 

We strongly recommend that you return the product via Registered Post and get proof of postage. You assume any risk of lost goods during transit and therefore we suggest you insure your parcel. Jackson’s Art Supplies will not be responsible for parcels lost or damaged in transit if you choose not to insure them. 

Returns after 30 days?

We don’t accept any returns for unwanted items after 30 days. If you try to make a return, we may have to send your item back to you and ask you to cover the delivery costs.

15. RECEPTION OF GOODS: DAMAGED, FAULTY OR MISSING ITEMS

We aim to minimise the risk of damage to products in transit by wrapping and packing as securely as possible and we aim to only supply products in a saleable condition, however there are rare instances when damage occurs in transit or products present manufacturing faults.

All products should be checked upon reception, and the parcels should be opened carefully to avoid spillages, further damage to goods, and/or damage to other property (carpets/clothing, etc).

Jackson’s Art Supplies will replace or refund any goods damaged in transit, but will not be held responsible for any secondary damage caused by those goods on arrival. We will not compensate you for damage caused by uncarefully opening a parcel (such as a long sharp blade through the box packing tape that cuts internal goods). 

If items within packaging are damaged, faulty or missing, please notify our Customer Service Team as soon as possible after delivery. Please keep the packaging, and any damaged or faulty products, so that we may assess the situation and to help us see where our packers can improve, and to claim the damages with the courier.

If you dispose of the packaging, and any damaged or faulty products, before contacting us, or contact us 14 days after delivery, then this could affect any claim.

We will always attempt to replace or refund any damaged, faulty or missing products.

16. Discounts

We offer discounts for large orders. This is on a case-by-case basis but usually starts when the order reaches $400 and may not be applicable to every item in the order. Teachers, art groups and professional artists often take advantage of this policy. Art groups can club together an order, so long as it is going to a single address in a single box.

Discount Codes

Please note, discount codes from third-party websites are often fake and will not work. All codes are intended for single use, and may be rescinded if shared or if used on multiple online accounts.

Discount codes can not be exchanged for cash or credit.

17. Our Loyalty Scheme

You can see your points and their value by viewing your account details in ‘My Account’.

With every 1$ you spend with us you will receive 10 points.

You can let the points build up and treat yourself to a free tube of paint, or redeem your points each time you shop. We will run additional points’ related offers and promotions, so look out for these online. 

Please note, points can only be used once and can’t be exchanged for cash.

18. Descriptions of Products

We take all reasonable care to ensure that all the details, descriptions and prices of products appearing on our website are correct. Colour swatches that appear online give a rough indication of the colour of the art supply listed, however, due to the different settings of computer monitors it is impossible to rely 100% on the accuracy of the image as viewed on screen. It is your risk to order unfamiliar colours, and the costs of any returns are your responsibility if the actual colour is not appropriate for your requirements. Although we aim to keep the website up-to-date, the information (including Product Descriptions) on this website may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted by us. We reserve the right to alter prices at any time. In the unlikely event that a price has been entered incorrectly on the website our customer service team will contact you as soon as possible to inform you of the correct price. You are under no obligation to continue with the order.

19. Gift Vouchers

If you are lucky enough to receive a Gift Voucher, please read and keep the following in mind:

1. Gift Vouchers can be exchanged for all goods sold by Jackson’s Art Supplies.

2. To redeem Gift Vouchers online please enter the code you were sent via email, in the “Gift Voucher” field, in the Basket or Checkout. When you place an order over the phone our Customer Service Team sales rep will ask you for the number on your Gift Voucher.

3. Gift Vouchers may not be exchanged for cash. 

4. Our Gift Vouchers are available in a variety of currencies to best suit your needs.

5. Once you have given us the number of your Gift Voucher for payment of an order, that Gift Voucher has been used and you will not be able to use it again. We suggest that you destroy all redeemed Gift Vouchers to avoid confusion.

6. If your order value is less than the value of the Gift Voucher, the code can be used again until all credit has been spent.

7. If you misplace your Gift Voucher email, please contact our Customer Service Team for help.

8. Gift Vouchers are valid for three years from the date of issue.

9. If you decide to return the items you purchased with your Gift Vouchers, you will not receive a cash refund. A credit note will be issued on your Website Account for subsequent orders. 

20. Affiliate Program

Our Affiliate Program is designed exclusively for artists, art educators, art demonstrators, art influencers, art groups, and art companies. By joining the Jackson’s Art Supplies Affiliate Program you agree to the terms and conditions set out below. We recommend that you read these and contact us if you have any questions.

In these Terms, the following words have the meanings attributed to them:

“Jackson’s Art Supplies” and/or “Jackson’s Art” means Jackson's Art Supplies Ltd, with registered office at 1 Farleigh Place, London, N16 7SX. In these terms the words “we”; “us” and “our” may also be used and refer to us, Jackson’s Art Supplies Ltd.

“Affiliate”; “you”; “your” means you, as a Jackson’s Art Supplies affiliate.

“Affiliate Account” means the account you set up when you register as an Affiliate.

“Affiliate Program” means our program for promotion of our brand by individuals who register with us as Affiliates.

“Confidential Information” means all documents, information and materials and any other proprietary information which we provide to you, and which ought reasonably to be considered as confidential information.

“Terms” means these Affiliate Terms and Conditions.

“Website” means our website found at www.jacksonsart.com.

Joining the Program

Upon acceptance, you will become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referred individuals.

Affiliate Responsibilities

It is understood that you will introduce our products to your current and prospective customers and will comply with all laws as well as those that govern email marketing and anti-spam laws. Jackson's Art Supplies reserves the right to accept or reject any prospective customers and will pay you a commission per customer referred, using your affiliate code according to the designated payment schedule.

Either you or Jackson's Art Supplies may terminate the affiliate relationship at any time. You are only eligible to earn affiliate payments during your time as an approved affiliate. Jackson's Art Supplies may change the program or service policies and operating procedures at any time.

Affiliate Relationship

This affiliate relationship is one of independent contractors. Jackson's Art Supplies will not be liable for indirect, special or consequential damages arising in connection with this program and our aggregate liability arising with respect to this program will not exceed the total referral fees paid or payable to you. Interspire makes no express or implied warranties or representations with respect to the program. In addition, Jackson's Art Supplies makes no representation that the operation of the service will be uninterrupted or error-free, and Jackson's Art Supplies will not be liable for the consequences of any interruptions or errors.

Approval or Rejection of Application

To sign up to our Affiliate Program, you will be asked to complete an affiliate registration form. Submitting an affiliate registration form does not guarantee inclusion in the Affiliate Program. We evaluate each and every application and are the sole exclusive decision makers on affiliate acceptance. If we chose not to include you in our Affiliate Program, we will attempt to notify you in a reasonable manner. If you don’t hear from us within a reasonable time frame, please consider your application rejected. We are not obliged to provide any explanation for your rejection. However, we may not approve your account if your website is still under construction or if you have limited blog posts on your website.

Affiliate links must only be used on an artist’s own website or social media profile. We will not pay any commission on sales driven by any unapproved digital advertising. We must be satisfied that your Affiliate Account links to your own artist website or social media profile. We will not approve accounts where your email address does not match the email address provided on your website contact page or website URL. We may contact you directly using your website contact page or social media profile to check the authenticity of your application.

You will have no legal recourse against us for the rejection of your Affiliate Program application.

Commissions

There is a limit of one commission per referral. If someone clicks the link on your site and makes multiple orders, you will receive a commission on the first order only.

Payments

You can choose to use or withdraw your commission like so:

1. You can request to have your commission converted to Store Credit, which can then be used as part or full payment for an order; or

2. You can have your commission paid out to a PayPal or bank account.

You will need to have a PayPal account set up in order to receive payments via PayPal. Please ensure when creating your Affiliate Account that the PayPal or bank account details you provide when setting up your account are correct. It is your responsibility to update your details if they change, so that we can action withdrawal requests and you can receive payments promptly.

If you choose to withdraw your balance, it is your responsibility to declare and pay any tax or insurance due on these payments. You agree to indemnify Jackson’s Art Supplies against any claims, losses, damages or any other liabilities which arise as a result of you not declaring and paying those sums.

Withdrawal requests for PayPal and Bank Transfers will be paid once a month. We process withdrawal requests on the last Friday of every month.

You’ll need to visit 'My Withdrawals' in your Affiliate Account menu, enter the requested withdrawal amount and then we will contact you to find out which option you'd prefer (PayPal, Bank Transfer or Store Credit) 

If you are planning on using your commission as Store Credit, once your withdrawal request has been approved (within 48 hours), simply select the 'Store Credit' option during the checkout process to deduct it from the total amount in your basket.

Refunds and Returns

If a customer returns purchased items within 30 days, the commission on those items will be cancelled.

Relationship Between Affiliates and Jackson’s Art Supplies

Neither you nor we are the agent or partner of the other. You agree that you will not promote yourself as an agent or employee of Jackson’s Art Supplies.

You also agree that you have no authority to enter any contract on behalf of Jackson’s Art Supplies or to bind Jackson’s Art Supplies in any way. You will not make any representation or indication that you are acting on behalf of, or are in any way capable of binding, Jackson’s Art Supplies.

We have the right to view your website at any time to determine if you are following these terms and conditions. You must display the legitimate Jackson’s Art Supplies banner on your website. We may notify you of any changes that we think you should make to your website. If you do not make the changes that we feel are necessary, we reserve the right to terminate your affiliate account.

Your Obligations as a Jackson’s Art Supplies Affiliate

You agree that you will:

Follow our reasonable instructions and requests in relation to your relationship with us as our Affiliate;

You also agree to not do the following:

(a) Create, or instruct, or allow anyone else to create a website, blog or social media accounts or pages for the sole purpose of advertising, promoting, or impersonating Jackson’s Art Supplies.

(b) Promote your Affiliate link using Google Ads or other digital advertising to run campaigns or create content which could reasonably be considered by anyone visiting it to be owned or maintained by us.

(c) Promote your Affiliate link using SPAM/unsolicited emails.

(d) Promote your Affiliate link in a way that may cause offence to others, including competitors.

(e) Promote your affiliate link on a coupon or promotional website.

(f) Use the website details of another artist to apply for the Jackson’s Art Supplies Affiliate Program.

If it comes to our attention that you are doing any of the above, we will consider that cause for immediate termination of your participation in the Jackson’s Art Supplies Affiliate Program. Any pending balances owed to you will not be paid if your account is terminated due to such unacceptable activities.

Imagery and Intellectual Property Requirements

As our affiliate you agree to use any intellectual property, videos or images given to you or chosen by you to use in the way they were originally received or intended. Therefore you agree to not do the following in any way:

Crop an image or video

Edit an image or video

Resize an image or video

If you are repurposing imagery or videos from our social media account to promote your affiliate link, direct attribution is required by tagging us.

Termination and Closure of Inactive Accounts

We do not place any obligation on our affiliates to meet quotas or guarantee sales. However, if any Affiliate Account is inactive for a period of one (1) year then we will close that account. This means any clicks using the unique link associated with that account will no longer be registered to that account and no commission will be payable in respect of any sales coming through that link.

You can choose not to be part of our Affiliate Program at any time for any reason. Please notify us that you wish to close your account via email, once this has been actioned, any purchases made via your affiliate link will no longer be attributed to your account. Any outstanding commission which has not already been paid/used on the date that your account is closed will be paid to you within 30 calendar days, providing your account and activity adheres to the terms and conditions set out in this document.

We can terminate your membership of our Affiliate Program at any time, for any reason, by giving you thirty (30) days written notice. At the end of this thirty (30) day period, we will close your account, meaning any transactions made using your referral link will no longer be registered to your account. Any commission which has not already been paid to you on the date that your account is closed will be paid through to you on our next payment date.

We can also terminate your membership of the Affiliate Program immediately if you breach any of these Terms. Any transactions made using your affiliate link will no longer be registered to your account. Once your account has been closed no further commission will be payable, including any commission which has accrued to your account but not yet been paid to you.

We may also terminate your membership of the Affiliate Program if:

You act in a way that we believe will negatively reflect on our reputation

You engage in behaviour that we deem to be misleading or fraudulent

In addition to the termination provisions above, either you or we will be entitled to terminate your membership immediately by notifying the other in writing if the other is declared bankrupt, enters into insolvency, or administration proceedings.

The rights to terminate set out above do not prejudice any other right or remedy available to you or us.

If your membership of our Affiliate Program is terminated for any reason you will be entitled to receive any unpaid commission registered on your Affiliate Account, unless payment is excluded for any reason set out in the above paragraphs. You will not be entitled to, or have any claim against Jackson’s Art Supplies for, compensation of any sort.

After termination of your Affiliate Account, you should immediately remove your affiliate link and all Jackson’s Art Supplies images, logos, and descriptions from your marketing and promotions.

Unless these Terms state otherwise, on termination of your Affiliate Account, neither you nor we will have any further obligation to the other under these Terms.

Rejection of Affiliate Account

If we reject your application, we will aim to let you know within a reasonable time frame. If we do not notify you of your acceptance into the Jackson’s Art Supplies Affiliate Program within thirty (30) days from your application, you may consider your application to have been rejected.

Confidentiality

You agree that you will keep your account details confidential and will not share them with any other person. You will also keep all marketing and other materials in relation to Jackson’s Art Supplies confidential and will not use them for any purpose other than in connection with the promotion of Jackson’s Art Supplies.
